Service Terms
1. Acknowledgmentand Acceptance of Terms
- SHEE’S FINE JEWELRY (the “Company”) providesservices under these Terms of Service (the “Services”). By registering for orusing the Services, you confirm that you have read, understood, and agreed tothese Terms, including any current and future features related to the Services.
- The Company may revise these Terms at anytime. Updated Terms will be posted on the website without separate notice. Ifyou continue using the Services after any update, you are considered to haveaccepted the revised Terms. If you do not agree, you must stop using theServices immediately.
- Minors may use the Services only with theaccompaniment and consent of a legal representative. See Section 5 for moredetails on the protection of children and adolescents using the website.
- You and the Company agree that anystatements of intent related to the Services may be made electronically.
2. MemberRegistration Obligations
To usethe Services, members must meet the following registration requirements:
- Provide accurate, current,and complete registration information, and do not register under someone else’sname.
- Each member may registerand use only one account.
- Keep your personalinformation updated so the Company can provide complete services.
- Do not provide false,inaccurate, incomplete, or insufficient information, omit required information,or register repeatedly.
3.Privacy Policy
Registrationinformation and other specified personal data will be collected, processed,used, protected, and managed under the Company’s Privacy Policy.
4. MemberAccount, Password, and Security
Afterregistration, you will receive an account and password. You are responsible forkeeping them confidential and secure. Any use of the Services through youraccount and password will be treated as your own, and you are responsible forall activities under your account.
Whenusing your account, you must follow these rules:
- Log out properly after eachuse. If your account or password is stolen, misused, or compromised, notify theCompany immediately.
- Your account, password, andrelated rights are for your personal use only and may not be lent, transferred,or shared.
- Unless the Company islegally responsible, it is not liable for losses caused by theft, misuse,unauthorized use, or uncertainty about whether you personally used the account.
- If the Company discoversfraudulent use of your account or password, it may immediately suspend theaccount, including related transactions.
5.Protection of Children and Adolescents
Toprotect children and adolescents online, users under 12 must use the Serviceswith a legal representative present. Users aged 12 to under 18 must read,understand, and agree to these Terms and any later changes with the consent orguidance of a legal representative before registering for, using, or continuingto use the Services. If a minor uses or continues using the Services, it willbe assumed that the parent or guardian has agreed to these Terms and any laterchanges.
6. LegalCompliance and User Commitments
Membersmay use the Services only for lawful purposes and by lawful means, and mustfollow the laws of the Republic of China (Taiwan) and general internetpractices. Members outside Taiwan must also comply with the laws of their localjurisdiction.
Membersmust not use the Services to violate others’ rights or engage in unlawfulconduct, including posting or distributing defamatory, insulting, threatening,offensive, obscene, false, or otherwise illegal content, or content thatviolates public order or good morals. Members must also not harm the reputationof the Company or any third party.
Membersshall not engage in the following conduct:
- Breaching any confidentiality obligations imposed by law or contract
- Using the Services under another person’s name
- Transmitting or distributing computer viruses, malicious code, or other harmful technical content
- Engaging in any commercial activity without the Company’s prior written or express authorization
- Publishing, transmitting, or sending spam, chain letters, unlawful information, unauthorized multi-level marketing messages or advertisements, or storing any material that infringes intellectual property rights or violates applicable laws
- Causing annoyance, discomfort, or offense to other users or third parties, or otherwise violating general internet etiquette
- Any other conduct inconsistent with the intended purpose of the Services or deemed inappropriate by the Company for legitimate reasons
7.Changes to Service Content and Newsletter / EDM Distribution
- The Company may add to, modify, or terminate all orpart of the Services based on business needs and actual circumstances, withoutproviding individual notice to each member.
- The Company may revise promotional orcampaign content as needed and will notify members appropriately.
- The Company may periodically send newsletters orproduct information (including EDMs) to the email address registered bymembers. If a member indicates that they do not wish to receive marketingcommunications, the Company will cease sending such messages.
8.Suspension or Interruption of Services
TheCompany will use reasonable technology and methods to maintain the normaloperation of its systems and Services. However, the Services may be suspendedor interrupted under any of the following circumstances:
- When the website or related electronic communication equipment undergoes necessary maintenance or construction
- When electronic communication equipment fails unexpectedly
- When telecommunications or internet services used by the Company are interrupted, making it impossible to provide the Services
- When the website is unable to provide the Services due to natural disasters, force majeure, or other causes not attributable to the Company
9.Transactions
- When using the Services to conduct transactions,members shall follow the quantity and price confirmation mechanisms provided bythe Company.
- After a member places an order, any notificationgenerated by the system shall only indicate that the order has been receivedand shall not constitute acceptance of the transaction. Before the Companyseparately confirms the formation of the transaction, it reserves the right toreject the order or cancel shipment. If the transaction terms of the product orservice (including but not limited to specifications, descriptions, or images)are incorrect, the Company may also reject the order within two business daysafter the order is placed.
- If a member engages in improper conduct such asarbitrary returns or exchanges, order cancellations, or any other behaviorcausing operational difficulties or damage to the Company, the Company mayrefuse future transactions or permanently revoke the member’s eligibility.Where an ordered product is a pre-order item, shown as out of stock, requiressupplier sourcing, or is shipped directly by a manufacturer, and the ordercannot be fulfilled due to the nature of the transaction or supply conditions,the Company will notify the member primarily by email and, if necessary, bytelephone, mail, or fax.
- Members using the Services for transactions mayexercise their rights in accordance with applicable consumer protection laws.If there is any ambiguity in these Terms regarding transaction content, suchambiguity shall be interpreted in favor of the consumer.
10.Limitation and Exclusion of Liability
- All services provided on this website are offered on an“as is” basis. The Company makes no express or implied warranties regarding theperformance, speed, completeness, reliability, security, or accuracy of theServices, except where otherwise required by mandatory law.
- The Company does not guarantee that the webpages, servers, domains, emails, orcontent of the Services are free from computer viruses or other harmfulelements, nor does it guarantee that the transmission or storage of emails,files, or data will be accurate, uninterrupted, or error-free. The Companyshall not be liable for any damage arising from transmission failure, storagefailure, loss, or errors, except where otherwise required by mandatory law.
11.Protection of Intellectual Property Rights
- All software, programs, and website content used by theCompany, including but not limited to works, images, files, information, data,website architecture, webpage arrangement, and webpage design, are protected byintellectual property rights legally owned by the Company or other rightsholders, including but not limited to trademark rights, patent rights,copyrights, trade secrets, and proprietary technologies.
- Without lawful authorization, no person may use,modify, reproduce, publicly broadcast, adapt, distribute, publish, publiclydisplay, reverse engineer, decompile, or disassemble such content.
- If a member wishes to quote or reproduce any of theforegoing content, prior written consent must be obtained from the Company orthe relevant rights holder. Respect for intellectual property rights is anobligation of all members. Any violation shall render the member liable fordamages, including but not limited to litigation costs and attorney’s fees.
- Members agree not to engage in any conduct thatinfringes the intellectual property rights of others while using the Services.In the event of infringement, the Company may suspend all or part of theServices or directly cancel the member’s account.
12.Authorization Granted by Members to the Company
(1)Personal Data
Thepersonal data provided by members may only be collected, processed, and used bythe Company within the scope necessary for specific purposes, includingproviding the Services, performing contracts, member management, customerservice, order processing, payment and delivery arrangements, after-salesservice, statistical analysis, system maintenance, and legal compliance, andshall be handled in accordance with applicable laws and the Privacy Policy.
(2)Member Content
If amember uploads, posts, submits, or otherwise provides reviews, images, text,audiovisual materials, or other content through the Services, the memberrepresents and warrants that they have the legal right to do so and that suchcontent does not infringe the rights of any third party.
For suchcontent, the member grants the Company the right to use it to the extentnecessary for providing the Services, website display, event promotion, andrelated operations. The scope, duration, and method of such authorization shallbe subject to the relevant campaign page, submission rules, or other separateannouncements.
13.Special Authorization
Becausethe Services may involve online transactions or activities requiring thedelivery or return of products or promotional items through courier or freightservice providers, members agree and authorize the Company to provide thepersonal data necessary for delivery (such as recipient name, delivery address,and contact number) to courier companies, freight carriers, or relevantbusiness partners, to the extent necessary for the relevant transaction oractivity, in order to complete delivery or collection operations.
14.Refusal or Termination of Use
Fortransaction security or operational management purposes, the Company mayterminate a member’s account, password, or the right to use all or part of theServices for any reasonable cause, including but not limited to prolongedaccount inactivity or violation of the express provisions or spirit of theseTerms. The Company may also remove or delete member content from the Services.If the Services or any part thereof are terminated for such reasons, theCompany shall not be liable to the member or to any third party.
15.Governing Law and Jurisdiction
Theinterpretation and application of these Terms of Service, and any disputesarising from these Terms or from transactions between members and the Company,shall be governed by the laws of the Republic of China (Taiwan). The TaiwanTaipei District Court shall have jurisdiction as the court of first instance,unless otherwise required by mandatory law.
